Electronic Document Disclosure
Introduction
Your consent to this Agreement is evidenced by your application for eStatements or electronic notifications. Please allow two (2) business days for the set up process. You will be notified when your electronic document is available
according to the document’s issue date.
Definitions
“You” or “Your” – The person applying for electronic delivery services
“We”, “Us” or “Our” – Refers to a Central Bancompany affiliate bank
“Relationship(s)” – Any relationship between you and us including, without limitation, checking accounts, savings accounts, loans, and investments
“Electronic communication(s)” – Paperless document transmissions originated or received through a computer
Terms
- In order to access and retain Electronic Communications, you must have:
- A personal device, operating system and telecommunications connections to the Internet capable of supporting such Internet browser
- One of the latest two versions of the following Internet browsers: Microsoft Edge, Apple Safari, Mozilla Firefox, Google Chrome or one of the latest two versions of: Android OS, or iOS.
- Internet browser support for 128-bit encryption
- An email account and email software
- Sufficient electronic storage capacity on your device’s hard drive or other data storage unit, in order to download and save electronic Legal Disclosures
- For our services which may furnish electronic information in .PDF format, Adobe Acrobat Reader, version 4.0 or greater and a personal device and operating system capable of supporting such software
- A printer capable of printing from your browser, email software or hard drive or other storage data unit, in order to print paper copies of electronic Legal Disclosures
- You request to receive the Electronic Communications, along with any required disclosures, via our Bank website or email, rather than by U.S. Mail. You will ensure the confidentiality of your user ID, password(s), and secret word and agree to indemnify, defend, and hold harmless, the Bank and its successors, assigns, affiliates, officers, employees, directors, and agents against any loss, claims, damages, judgment, awards, legal obligations, costs, or expenses, including, without limitation, all fees and expenses of Bank’s counsel based upon arising out of, or related in any way to the Bank’s honoring this request.
- You agree to keep us informed of your current email address(s) by advising us of changes in writing or by sending us the address through our secured website.
- You agree to promptly review each Electronic Communication after receipt of notification of availability.
- If we change the minimum hardware or software requirements, and you are unable to receive Electronic Communications, you will be released from this Agreement without any penalty or consequence to you.
- You may withdraw your request for Electronic Communications by sending a written notice to the address provided on our website or at one of our locations. Upon withdrawal, the documents will be sent in paper form to your address of record. After you no longer receive Electronic Communications and begin receiving documents in paper form, you may be assessed a monthly fee.
- Upon termination of Electronic Communications by you or by us, a new request will be required to reinstate Electronic Communications.
- This Agreement shall be governed by the laws of the United States and the state where our principal office is located and by regulations of any governmental agency having jurisdiction over us. A determination that any provision of this Agreement is unenforceable or invalid shall not render any other provision of this Agreement unenforceable or invalid.
- This Agreement supplements any other agreements or disclosures related to your Relationships with us. If there is a conflict between this Agreement and any others, or any statements made by employees or agents, the information in the primary documents associated with the Relationship shall supersede.
- If for any reason you do not receive the Electronic Communications, you may request a paper document by sending a written notice to the address provided on our website or by making the request at one of our locations at no charge for up to thirty (30) days following the Electronic Communication’s issue date. Any reproduction of an Electronic Communication requested after the thirty (30) days will be subject to fees.
- Your request to receive Electronic Communications shall continue in full force and effect indefinitely unless and/or until it is withdrawn or terminated as provided above and shall apply to all of your current and future Relationships with us. You may withdraw your request to receive Electronic Communications with respect to one or more Relationships at any time by following the procedures outlined above and specifying the Relationship(s) for which you no longer want to receive Electronic Communications.
